By accessing or using MilestonesIQ ("the Platform"), you agree to be bound by these Terms of Service. If you are accessing the Platform on behalf of a Graduate Medical Education (GME) program, residency program, fellowship program, or academic medical institution ("Program"), you represent that you have authority to bind that Program to these Terms.
MilestonesIQ is a web-based platform designed to support GME programs in tracking trainee milestone progression, managing Individualized Learning Plans (ILPs), organizing Performance Improvement Plans (PIPs), facilitating mentor-mentee relationships, and generating AI-assisted performance summaries. The Platform serves as a universal growth and development tool for all GME trainees — residents, fellows, and other clinical trainees — across all medical specialties.
Access to the Platform requires account registration. The Platform supports three primary user roles: Program Director (PD), Trainee, and Mentor. Each role has distinct access permissions enforced by role-based access controls. Program Directors have administrative access to cohort-level data. Trainees have access only to their own performance data. Mentors have access only to data pertaining to their assigned trainees.
MilestonesIQ processes trainee performance data that may constitute "education records" as defined under the Family Educational Rights and Privacy Act (FERPA), 20 U.S.C. § 1232g. The Program (as the educational institution) retains ownership of and responsibility for those records. MilestonesIQ processes trainee data solely as a service provider acting on behalf of the Program. Trainees retain rights to their educational records as provided under FERPA.
MilestonesIQ is designed to process trainee performance and educational data, not patient health information. Programs are responsible for ensuring that no Protected Health Information (PHI) as defined under HIPAA is entered into the Platform without a fully executed Business Associate Agreement (BAA) with MilestonesIQ. All AI-generated outputs are advisory in nature only. They are intended to assist Program Directors and faculty in identifying patterns and supporting trainees — not to make, recommend, or automate any employment, academic, or disciplinary decisions. Every AI-generated risk flag or summary requires review and disposition by a qualified Program Director before any action is taken. No adverse action may be based solely on an AI-generated output.
All trainee performance data and program-specific content entered into the Platform remains the property of the Program and its trainees. MilestonesIQ does not claim ownership of Program Data. MilestonesIQ owns all intellectual property rights in the Platform, including its software, design, algorithms, and documentation.
You agree not to use the Platform to enter data you do not have the right to use, circumvent role-based access controls, make adverse decisions based solely on AI outputs without independent human review, or violate applicable law including FERPA, HIPAA, or anti-discrimination statutes.
Access to the Platform is provided on a subscription basis. Current pricing is available upon request at [email protected]. Fees are billed in advance on a monthly or annual basis. MilestonesIQ reserves the right to modify subscription fees upon thirty (30) days' written notice.
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. MILESTONESIQ DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED OR ERROR-FREE.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MILESTONESIQ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. IN NO EVENT SHALL MILESTONESIQ'S TOTAL LIABILITY EXCEED THE FEES PAID BY YOU IN THE PRECEDING TWELVE (12) MONTHS.
These Terms are governed by the laws of the State of Illinois. Disputes shall be resolved by binding arbitration in Cook County, Illinois, under the rules of the American Arbitration Association.
MilestonesIQ reserves the right to modify these Terms at any time with thirty (30) days' written notice. Continued use of the Platform after the effective date constitutes acceptance of the revised Terms.
